The agreement that governs your use of the American Health & Safety training platform — for individual learners, corporate clients, and the managers who oversee them.
EFFECTIVE Version 1.0 LAST UPDATED April 25, 2026 GOVERNING LAW United States SCOPE AHS Platform
These Terms & Conditions (“Terms”) form a binding agreement between you and American Health & Safety (“AHS,” “we,” “us,” or “our”) governing your access to and use of the AHS training platform, including our website, course library, learning management system, and any related services (collectively, the “Platform”). By creating an account, purchasing a course, enrolling a learner, or otherwise using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
If you are accepting these Terms on behalf of a company or organization, you represent that you have the authority to bind that entity, and “you” will refer to that entity throughout this agreement.
Throughout these Terms we use the following defined terms:
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or purchase courses. The Platform is designed for occupational safety training and is not intended for general consumer or child use. Corporate Clients are responsible for ensuring that learners they enroll meet the eligibility requirements of the courses assigned to them.
The Platform supports four primary roles, each with distinct permissions:
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Account sharing is prohibited and may invalidate any certificates issued under that account.
When you sign up as a Corporate Client, AHS provisions a dedicated workspace for your organization. The workspace includes seat-based or subscription access to selected courses, one or more Client Manager accounts, and segregated reporting visible only to your organization.
Individual Users may purchase courses directly through our WooCommerce-powered store. Upon successful payment, you will be automatically enrolled in the course(s) purchased and granted access for the period stated on the product page (typically 12 months from the date of purchase, unless otherwise noted).
Bundles, subscriptions, and promotional pricing are governed by the specific terms displayed at checkout, which are incorporated into these Terms by reference.
Course access is personal, non-transferable, and limited to the term you have paid for or been assigned. You may resume an in-progress course at any time during the access period, and your progress (including bookmarks, time spent, and quiz attempts) is automatically saved.
AHS reserves the right to update, replace, or retire courses to keep content aligned with current OSHA, ANSI, NFPA, EPA, DOT, and other applicable standards. Where a course is materially revised mid-term, learners with active access will be migrated to the updated version at no additional cost.
Certain courses include or are delivered as Live Sessions through Zoom integration. By joining a Live Session, you agree that:
The Platform uses Tin Canny and SCORM-compliant tracking to record detailed learning data, including time spent in each module, slide-level progress, quiz responses and scores, completion status, and certificate issuance. By using the Platform, you acknowledge and consent to this tracking, which is essential to the integrity of safety certifications.
For Corporate Client learners: this data is shared with your employer’s Client Manager for the purpose of training oversight and audit compliance. This is not optional — it is the basis on which your employer is paying for your training.
Upon successful completion of a course — including passing any required assessment with the minimum score stated on the course page — AHS will issue a digital certificate bearing a unique verification ID, the learner’s name, the course title, the completion date, and the issuing standard where applicable.
The Platform, Course Content, brand assets, course architecture, assessments, and underlying software are owned by AHS or its licensors and are protected by U.S. and international copyright, trademark, and other intellectual property laws. Subject to your compliance with these Terms, AHS grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for the purposes described in these Terms.
You may not copy, reproduce, redistribute, sell, sublicense, publicly display, modify, reverse-engineer, or create derivative works from any part of the Platform or Course Content without our prior written permission. Use of Course Content to train artificial intelligence or machine learning models is expressly prohibited.
You agree not to:
Violations may result in immediate suspension, certificate revocation, and forfeiture of fees paid.
The Platform integrates with third-party services including Zoom (live sessions), payment processors (purchase processing), and analytics providers. Your use of these services is also subject to their respective terms and privacy policies. AHS is not responsible for the availability, accuracy, or conduct of third-party services beyond our reasonable control.
The Platform and Course Content are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.
Course Content is for educational purposes and is not a substitute for site-specific safety procedures, qualified supervision, professional engineering judgment, or competent legal advice. Compliance with OSHA and other regulatory standards in your workplace is your responsibility, not ours.
To the maximum extent permitted by applicable law, AHS, its affiliates, officers, employees, and licensors will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to lost profits, lost data, business interruption, or workplace incidents arising from or related to your use of the Platform.
Our aggregate liability for any claim arising out of these Terms or your use of the Platform will not exceed the amount you paid to AHS in the twelve (12) months immediately preceding the event giving rise to the claim.
You agree to indemnify, defend, and hold harmless AHS and its affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any law or third-party right; or (d) for Corporate Clients, the conduct of your users on the Platform.
AHS may suspend or terminate your account for material breach of these Terms, non-payment, fraudulent activity, or any conduct that endangers other users or the integrity of certifications. Where practical, we will provide notice and an opportunity to cure.
You may terminate your account at any time by contacting us. Upon termination, you will lose access to in-progress courses, but completion records and certificates already issued will remain on file for the audit retention period and may be exported on written request.
These Terms are governed by the laws of the State of [Insert State], United States, without regard to conflict-of-laws principles. Before initiating any formal proceeding, the parties agree to attempt to resolve disputes in good faith for at least thirty (30) days. Unresolved disputes will be submitted to binding arbitration in [Insert City, State] under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property infringement.
Class action waiver: You agree to resolve disputes on an individual basis and waive any right to participate in a class, collective, or representative action, except where prohibited by law.
We may update these Terms to reflect new features, regulatory requirements, or operational changes. Material changes will be communicated by email and dashboard notice at least thirty (30) days before they take effect. Continued use after the effective date constitutes acceptance.

American Health & Safety (“AHS,” “we,” “us,” or “our”) operates this online safety training platform. This Privacy Policy explains how we collect, use, share, and protect personal information when you visit our website, purchase courses, or complete training through our platform.
For Individual Users, AHS is the data controller of your personal information. For Corporate Client learners, your employer is typically the data controller and AHS acts as the data processor on their instructions.
We collect the following categories of information:
We do not collect biometric data, social security numbers, financial account numbers (beyond payment processing), or content from your camera or microphone outside of explicitly consented Live Sessions.
We do not sell your personal information. We do not share it with third parties for their independent marketing purposes.
Where data protection law requires a legal basis, we rely on:
The platform is built so that each Corporate Client operates inside an isolated workspace. Client Managers can only see and report on learners belonging to their own organization. AHS Administrators may access cross-client data internally to operate, secure, and improve the platform, but will not disclose one Corporate Client’s data to another except where compelled by law.
Where AHS acts as a processor for a Corporate Client, processing is governed by the underlying service agreement and any applicable Data Processing Addendum (DPA). Corporate Clients can request a signed DPA at any time.
The platform records detailed learner activity using SCORM 1.2 / 2004 packages and the Tin Canny xAPI layer, including: time on each slide, quiz attempts and answers, pass/fail outcomes, bookmarks, and completion timestamps. This level of tracking is necessary to verify that training was actually completed — a core requirement of OSHA recordkeeping and customer audit obligations.
Learners enrolled by an employer should expect this data to be visible to their Client Manager and to AHS staff supporting the account.
WooCommerce-powered purchases are processed by PCI-compliant payment processors (such as Stripe or PayPal). AHS receives confirmation of payment and limited card metadata (brand, last four digits, expiration), but never receives or stores full card numbers, CVV codes, or full bank account details.
When you attend a Live Session through our Zoom integration, Zoom and AHS will process: your name, email, IP address, attendance and duration, in-meeting chat (where enabled), camera and microphone feed (only while you transmit), and recordings (where the session is recorded).
Recordings are used for audit verification, makeup access for absent learners, and quality improvement. Zoom acts as a sub-processor and is bound by its own privacy commitments.

We respond to verified requests within 30 days. There is no charge for reasonable requests.
If you are a California resident, you have the right to know what personal information we collect, to request deletion, to correct inaccurate information, to limit use of sensitive personal information, and to opt out of sale or sharing for cross-context behavioral advertising. We do not sell or share personal information for cross-context behavioral advertising. You may exercise your rights by contacting privacy@AHS.com or using the cookie panel in your account settings.
If you are located in the European Economic Area, the United Kingdom, or Switzerland, you have the rights described in Section 13 under the GDPR or UK GDPR. The legal bases on which we rely are described in Section 04. Where we transfer personal data outside your region, we use Standard Contractual Clauses or another approved transfer mechanism.
You have the right to lodge a complaint with your local supervisory authority. We will respond to your data protection authority’s inquiry promptly.
The AHS platform is built for adult workplace learners. We do not knowingly collect personal information from children under 16. If you believe a child has provided us information without parental consent, please contact privacy@AHS.com and we will delete the information promptly.
AHS is based in the United States and may process your data on servers located in the U.S. or in regions where our sub-processors operate. Where personal data is transferred from regions with stricter data protection laws (such as the EU/UK), we rely on Standard Contractual Clauses, adequacy decisions, or equivalent safeguards.
We may update this Privacy Policy from time to time to reflect new features, regulatory requirements, or operational changes. Material changes will be communicated by email and dashboard notice at least 30 days before they take effect, unless an earlier effective date is required by law. The “Last updated” date at the top of this policy reflects the most recent revision.
